Sept. 27: Judge Beesecker dismissed the case against Martin Sauer, saying that the interest of justice would not be served by subjecting the defendant to the expense of a trial. The judge had previously denied a motion to dismiss the case on its merits.
The police had charged Mr. Sauer with peddling without a license on July 21 after he refused to move his vegetable truck from its traditional location on Route 32. Mr. Sauer had a county license at the time, but he didn’t have it with him.
The defendant was not in court tonight. He was represented by his attorney, Christopher Kleister.
While Mr. Sauer is continuing to sell from his truck on weekends, the Department of Transportation has told him he will have to find another spot by mid-October.
