Judge delays decision in kayak case

Attorney Richard Portale seemed perplexed when he spoke briefly to reporters following a court hearing earlier today. Judge Robert Freehill was expected to make a decision as to what evidence would be allowed in the Angelika Graswald trial. Graswald is accused of killing her fiancee, Vincent Viafore, who drowned in the Hudson River in April of last year.

Instead of making a ruling, Freehill postponed, until Sept. 30, his decision. Freehill said he expects to set a trial date at that time as well. Portale told reporters he has until Sept. 9 to submit papers in support of his position.
