It’s called an Article 78. It’s a legal proceeding where a petitioner seeks to overturn an administrative decision.
A local government can file an Article 78. And that’s what the Town of Cornwall plans to do. After reviewing a report from Maser Consulting, the Town Board will ask the courts to annul the permit for Kiryas Joel’s well on Route 32 in Mountainville.
The Maser report, which the Town received on Nov. 2, maintains that the DEC has not provided adequate safeguards to protect the stream and neighboring wells. The report also refers to a “number of substantive errors.”
